The matter came up for hearing on the 15th March 2011; this was a mention to confirm whether the parties had agreed to the consent.
Mr. Munge was present for the respondents; Ms. Onyango Oduor was present for KMA , Mr. Omwanza for the interested parties ( CSO’s), Mr. Otieno for the pharmaceutical association, and Mr. Mutinda for the state.

AIDS LAW PROJECT (ALP) – VS. – THE HON ATTORNEY GENERAL AND THE DIRECTOR OF PUBLIC PROSCUTIONS
This matter came up for hearing before Hon. Justice Musinga on the 15th February 2011.
The Government of Kenya, through the Minister of State for Special Programmes in Legal Notice no. 80 published on 5th November 2010 stated that the commencement date for the operationalisation of section 24 of the HIV and AIDS Prevention and Control Act would be the 1st December 2010.
Two percent freight on board value on all drugs imported into the country
The minister for medical services,vide legal notice No. 191 of 2010 dated the 18th November, 2010has purported to levy a two percent freight on board value on all drugs imported into the country,this is in addition to the usual import declaration Fee (IDE) of 2.75% that is levied on such drugs.

HIV/AIDS prevention and control act (HAPCA) booklet is available online,You can now download it from Aids law project website link.The booklet has been distributed to various human rights partners and to the society.A community radio will be used to educate and pass the information to the public about the act,Aids Law project is to establish networks within radio stations.
Strategic Litigation
Section 24: Aids Law project tried to mobilize different partners to strategize on areas of advocacy i.e. NEPHAK, IPPF (support in international advocacy). The date given for the budgetary fund to be released for the HIV tribunal is the 31st of January. Tess is to find out when the operationalization of the tribunal will be from National Aids control council (NACC).
Taxation (2%) on Anti ARV’s and essential drugs: ALP wants it to stay from operating. An organization has gone to court to seek an injunction
Legal Literacy Trainings
Aids Law Project will conduct a two day trainings for 50 participants.It will be held for People living with HIV/Aids groups.It will also target low income earners in informal settlements in Nairobi.

Out patient benefits and the National hospital insurance fund (NHIF)
National Hospital Insurance Fund (NHIF) recently announced that they will be increasing the rates of the contributions by about 500 % – 600% along with establishing outpatient coverage. The Central Organization of Trade Unions (COTU) sought to have NHIF restrained from enforcing the new contributions.
Damaging effects of impending trade agreements on access to Hiv medication
Over the past couple of years there has been a tremendous improvement in the fight against HIV and aids of importance concern is the anti retro viral drugs that have helped prolong the lives and dramatically improve peoples health taking them from near death back to health, family and employment. Across the developing world more than five million people receive anti retro viral drugs which represent important progress.
